1. About these terms
These Terms of Use (“Terms”) govern your access to and use of the DBOT Estimator (“the app”), run by Digimasters Ltd, a company registered in England and Wales (company number 10917139). References to “Digimasters”, “we”, “us” or “our” refer to Digimasters Ltd.
By signing in to or using the app, you agree to these Terms. If you do not agree, please do not use the app.
If your organisation has a contract with Digimasters, that contract governs our relationship with your organisation and takes priority over these Terms where they differ. Our website, digimasters.co.uk, has its own terms of service.
2. Access
The app is available only to people we, or the owner of an estimate, have given access to. Signing in does not by itself give access to any client or estimate. You must:
- use only your own account, and sign in only with an email address you are entitled to use
- not forward a sign-in link to anyone else - it signs in whoever uses it as you
- tell us straight away at support@digimasters.co.uk if you think someone else has used your account or seen information they should not have
- sign out when you use a shared or public computer
We may suspend or remove access at any time, for example when an engagement ends, at the request of your organisation, or if we reasonably believe these Terms have been broken.
3. Acceptable use
You may use the app for lawful purposes only. You must not:
- use the app in any way that breaks applicable laws or regulations
- try to gain access to any client, estimate, account or part of the app or its connected systems that you have not been given
- introduce viruses, trojans, worms, logic bombs or other malicious or harmful code
- use automated tools to scrape, crawl or extract content from the app without our written agreement
- enter personal data that an estimate does not need, or any special category data (such as health information)
4. Estimates are estimates
The figures in the app are planning estimates. They are not quotes, offers or commitments by Digimasters, and a range in the app is a bound on what an estimate might be, not a forecast of what it will be. Digimasters is bound by a price only when it is set out in a signed contract or statement of work. Decisions made using the app’s figures are the responsibility of the organisation making them.
5. Confidentiality
The app holds commercial information belonging to Digimasters and to our clients, including day rates, pay bands, budgets and estimates. You must keep it confidential, use it only for the purpose it was shared with you for, and not pass it on - including by exporting, printing, forwarding or sharing a link - to anyone outside your organisation without the agreement of the organisation it belongs to.
6. Intellectual property
The app, its design and software, and Digimasters’ estimating method, sizing standards and rates are owned by or licensed to Digimasters Ltd and are protected by UK and international intellectual property laws. A client’s own content in the app belongs to that client.
You may view, print and export content from the app for your organisation’s own use in connection with its work with Digimasters. You must not otherwise reproduce, modify, distribute or republish it without our prior written consent.
7. Personal data
Our privacy notice explains how we use personal data in the app, and our cookie notice lists the cookies and browser storage it uses.
8. Availability and changes to the app
We work to keep the app available and accurate, but we do not promise that it will always be available, uninterrupted or free from errors. We may change, suspend or withdraw any part of it. Where a change affects how an estimate is worked out, we describe it in the app’s list of changes.
9. Limitation of liability
Subject to any contract between Digimasters and your organisation, the app is provided on an “as is” basis and we make no warranties, express or implied, about the accuracy, completeness, reliability or suitability of its content or figures for any particular purpose.
To the fullest extent permitted by law, and subject to any contract between Digimasters and your organisation, Digimasters Ltd excludes liability for any loss or damage arising from your use of, or inability to use, the app, including indirect, consequential or economic loss.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.
10. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless a contract between Digimasters and your organisation says otherwise.
11. Changes to these terms
We may update these Terms to reflect changes in the law, the app or our practices. The current version will always be on this page with the date it was last updated. If we make significant changes, we will tell the people using the app directly where we can. Your continued use of the app after a change means you accept the updated Terms.
